Hello all:
I agree entirely with Frank. Having just spoken with our consortium attorney, I can tell you that at least in New York, because patrons self-initiate a relationship with the Elf, and the patrons themselves voluntarily provide their personal information, the onus is on the patron and not the library or the consortium.
That said, our attorney agrees that disclaimer language on our web/catalog page is a good idea.
It's also important that we encourage III to continue the patron empowerment thread of development so that we are in a position to offer our patrons such services ourselves.
In our case the issue will be on our next Board agenda. Although I would never presume to speak for the Board, based on our list discussion and my conversation with our attorney, my guess is that we will acknowledge that we have been "Elfed", develop the disclaimer language, and go on with our lives.
