LibraryElf has come to my attention very recently, since, apparently, one of my consortium member libraries has subscribed (if that's the right word).
We have also, coincidentally, recently had a special meeting to discuss patron privacy issues with our consortium attorney. From that standpoint, although I have not verified this with counsel, the fact that the patron him or herself must set up their own Elf account and provide what might be considered confidential information constitutes explicit consent and is therefore probably not a legal issue for the consortium.
However, our consortium bylaws do require libraries to obtain permission to install or provide access to any third party hardware or application by way of our system, and the library providing access to Elf for its patrons has not done that, so we may have a violation of our own bylaws on our hands.
I have not had an opportunity to review this matter in any depth yet. However, if there is no legal issue and the matter of our own bylaws and their requirements are clarified with our members, I don't know that we would attempt to block it. Although my Board is aware of this service, we have not had the opportunity to discuss it in detail and for them to take a position about it.
